In compliance with the provisions of Law No. 29733 – Personal Data Protection Law (hereinafter, the "Law") and its Regulations, approved by Supreme Decree No. 016-2024-JUS (hereinafter, the "Regulations"), C.H. PLENGE & CIA S.A. wishes to inform its users of the following aspects related to their personal data:
1. Personal Data Database
Through the information processing that takes place on the website https://www.plengelab.pe (hereinafter, the "Website"), C.H. PLENGE & CIA S.A. with RUC No. 20100315247 and with address at Av. Del Ejército No. 1142, district of Miraflores, province and department of Lima (hereinafter, "THE COMPANY"), has a personal data database called "Website Users and Cookies", which has been registered with Code No. PJ-2025-1874.
Users are informed that any processing of personal data complies with the provisions of the Law and the Regulations.
2. Purpose
The personal data collected on the website is used to provide users with information related to THE COMPANY's services and for the dissemination of commercial activities.
For these purposes, THE COMPANY may transfer personal data to entities for the provision of telecommunications services.
Additionally, for web hosting service reasons, personal data is transferred to JOSE DANTE SAENZ SANCHEZ E.I.R.L., identified with RUC No. 20556583821.
Your personal data will only be used for limited purposes, as stated above. Likewise, they will not be shared with third parties (except for those mentioned above), unless there is your express consent and/or legal requirement.
3. Data Retention Period and Security Measures
Personal data will be retained as long as necessary for the fulfillment of the purposes established in the previous section and up to 1 (one) year after or until cancellation is requested. THE COMPANY has implemented technical, organizational, and legal measures that guarantee the security and confidentiality of personal data.
4. Exercise of Rights of Information, Access, Rectification, Cancellation and Opposition of Data
The user, as the owner of their personal data, has the right to access the information that THE COMPANY has in its possession, know how it is being used, correct it if it is incorrect or incomplete, and request its deletion or cancellation if it is no longer necessary for the established purposes. In addition, the user may object to its processing for certain purposes and, at any time, revoke the previously granted consent, as well as restrict the use or disclosure of their personal data.
The user may direct their request to exercise rights in the terms established by the Regulations to the email: quimica@plengelab.pe.
In this regard, they must submit - at the address or email specified above - the respective request in the terms established by the personal data protection regulations.
The maximum term to attend to requests and claims received will depend on the right being exercised:
- Right of access: Twenty (20) business days counted from the day following the presentation of the request by the owner or rectification, in case it has been required.
- Right of rectification, cancellation and/or opposition: Ten (10) business days counted from the day following the presentation of the request by the owner or rectification, in case it has been required.
- Right of information: Eight (8) business days counted from the day following the presentation of the request by the owner or rectification, in case it has been required.
These terms may be extended by the same number of days, in which case THE COMPANY will inform users in a timely manner.
In any situation, response times will be adjusted to the terms and deadlines established by the personal data protection regulations, as long as all necessary information for the request has been provided.
If the owner of personal data considers that they have not been attended to in the exercise of their rights, they may file a claim with the Personal Data Protection Directorate, by going to the Records Office of the Ministry of Justice and Human Rights, located at Ca. Scipión Llona No. 350, Miraflores, Lima, Peru or to the Judiciary for the purposes of habeas data action.
5. Cookies
THE COMPANY informs users that cookies are used on the Website to facilitate use and navigation through the Website and improve its quality according to users' browsing habits and styles.
A. Definition
